These Terms of Use (“Terms”) are an agreement between you and Realtie (“Realtie”, “we”, “us” or “our”), a business based in British Columbia, Canada. They apply when you visit realtie.ca, create an account, start a free trial, buy a subscription, or download, activate or use the Realtie WordPress plugin, its licence keys, updates, documentation (including the Realtie Handbook) and support (together, the “Services”).
By using the Services, or by checking the box at checkout, you agree to these Terms and to our Privacy Policy. If you are agreeing on behalf of a company, brokerage or team, you confirm that you have authority to bind it, and “you” means that organization. If you do not agree, do not use the Services.
1. Who the Services are for
- Realtie is designed mainly as a business tool for real estate professionals, brokerages and the people who build websites for them.
- You must be at least 18 years old and able to enter into a binding contract.
- You must give us accurate account and billing information and keep it up to date.
2. Your account
- You are responsible for keeping your login details and licence keys confidential, and for everything that happens under your account.
- Tell us right away at support@realtie.ca if you think your account or licence key has been used without permission.
3. Plans, prices and billing
- Our current plans and prices are listed on our Pricing page. Prices are in Canadian dollars (CAD). Applicable sales taxes are added where required by law.
- Subscriptions renew automatically at the end of each billing period (monthly or yearly) at the then-current price, until you cancel. By subscribing, you authorize us and our payment processors to charge your payment method for each renewal.
- Payments are processed by third-party payment processors (WooPayments, powered by Stripe, and PayPal). We do not store your full card number.
- Done-for-you setup is an optional one-time service you can add at checkout (currently $199 CAD plus applicable taxes). It is charged once, with your first payment, and is never added to renewals. To protect your account, you enter your own CREA DDF® credentials yourself; we never ask for them.
- We may change our prices. A price change will not apply to a billing period you have already paid for. We will email you at least 30 and no more than 60 days before a new price applies to your subscription, and you can cancel without charge before it takes effect.
4. Free trial
- New customers may be offered a free trial (currently 5 days). A payment method is required to start a trial.
- We will email you a reminder before your trial ends. If you do not cancel before the trial ends, your paid subscription starts automatically and your payment method is charged for the first billing period. Your trial end date is shown at checkout, in your order confirmation and in My Account.
- Free trials are limited to one per customer, business and website. We may refuse or end a trial if we believe it is being misused.
- The free trial covers your plan only. If you add done-for-you setup, its one-time fee is charged at checkout, even during the trial.
5. Cancelling and refunds
- You can cancel at any time from My Account → Subscriptions, or by emailing support@realtie.ca. There are no cancellation fees.
- When you cancel, your subscription stays active until the end of the period you have already paid for. It will not renew after that.
- Done-for-you setup: if we have not started your setup yet, you can ask us to cancel it for a full refund of the setup fee. Once setup work has begun, the setup fee is non-refundable.
- For yearly plans, we will email you a reminder before your renewal date, at least 30 days and no more than 60 days ahead, so you have time to cancel.
- When your subscription ends, your licence becomes inactive and imported listings are hidden from your website (not deleted), as described in section 6.
- Except as set out below, payments are non-refundable, and we do not give refunds or credits for partial billing periods or unused time, unless we charged you in error. If you believe a charge is wrong, contact us within 30 days of the charge.
- If you are a consumer in British Columbia, or in another province or territory with similar laws, you may cancel at any time and will receive any refund those laws require, including for a renewal that you cancel after it is charged.
- Please contact us before disputing a charge with your bank. Most billing problems can be fixed quickly by email.
6. Failed payments
If a renewal payment fails, we will try to charge your payment method again and let you know. Your licence stays active for a 7-day grace period. After that, your licence becomes inactive: plugin updates and support stop, and imported listings are hidden from your website (they are paused, not deleted). Everything comes back when you renew.
7. The Realtie plugin and your licence
- Software licence. The Realtie plugin is distributed under the GNU General Public License, version 2 or later (GPL). Nothing in these Terms limits the rights the GPL gives you in the copy of the code you received.
- What your subscription includes. Your subscription gives you a licence key, access to downloads and updates, the Realtie Handbook, connection to our licence and update servers, and support for your plan, for as long as your subscription is active.
- One website per licence. Unless your plan says otherwise, each licence key may be activated on one live website at a time. You may move a licence to a different website by deactivating it first.
- Licence keys are personal to you. You may not share, sell, publish or transfer your licence key, or use it on websites you are not entitled to. We may deactivate keys that are shared, resold or used in a way that breaks these Terms.
- The Realtie name and brand. The GPL covers the code only. It does not give you any right to use the Realtie name, logo or branding, or to present a modified version as an official Realtie product.
8. CREA DDF®, MLS® listings and your data feed
- You need your own DDF® access. Realtie is software that connects to a CREA DDF® data feed that you (or your brokerage) are authorized to use. We do not supply, sell, licence or own any listing data, and buying Realtie does not give you access to any data feed.
- You are responsible for compliance. You are solely responsible for obtaining and keeping your DDF® access, and for complying with the CREA DDF® Policy and Rules, the REALTOR® and MLS® trademark rules, your brokerage’s and board’s requirements, and all applicable laws when you display listings. This includes required logos, brokerage attribution, disclaimers and how often your listings are refreshed.
- Listing accuracy. Listing content comes from your data feed and its contributors. We are not responsible for errors, omissions, delays or removals in that content.
- Not affiliated with CREA. Realtie is not owned, endorsed or sponsored by The Canadian Real Estate Association (CREA). The trademarks REALTOR®, REALTORS® and the REALTOR® logo are controlled by CREA and identify real estate professionals who are members of CREA. The trademarks MLS®, Multiple Listing Service® and the associated logos are owned by CREA and identify the quality of services provided by real estate professionals who are members of CREA. DDF® is a trademark of CREA. We use these marks only to describe compatibility.
9. Your website, your content and your visitors
- The Realtie plugin runs on your WordPress website. You are responsible for your website, hosting, backups, security, theme and other plugins, and for the content you publish.
- Your DDF® credentials and listing data stay on your website. Realtie does not receive them, unless you send them to us or give us temporary access to your website for a support request.
- Leads and enquiries submitted through forms on your website are collected by you, on your website. You are responsible for handling your visitors’ personal information under applicable privacy and anti-spam laws (including PIPEDA, provincial privacy laws and Canada’s Anti-Spam Legislation), and for having your own privacy policy.
- Keep regular backups. We are not responsible for the loss of data on your website.
10. Acceptable use
You agree not to:
- break any law, or infringe anyone’s intellectual property, privacy or other rights;
- use the Services to send spam or unlawful messages, or to collect personal information without consent;
- use invalid, shared or altered licence keys to access our licence or update servers, or overload, probe, scan or attack our websites or servers;
- resell or give others access to your licence key, the Realtie Handbook or support without our written permission (this does not limit your rights under the GPL to copy, modify or share the plugin code);
- copy or republish the Realtie Handbook or other members-only content; or
- use the Services in a way that could harm Realtie, our customers or the public.
11. Support
- Support is provided by email at support@realtie.ca. We do not offer phone support.
- The Plugin + Support plan includes priority email support, step-by-step help setting up your DDF® feed, and help with field mapping and theme conflicts. We aim to reply to priority requests by the next business day. The Plugin plan includes bug reports by email.
- Response times are targets, not guarantees, and we do not guarantee that every issue can be resolved. Support covers the Realtie plugin itself. It does not cover your hosting, other plugins, custom code, or your DDF® account with CREA.
- To help you, we may ask for information about your website, or for temporary access to it. Only give us access you are comfortable with, and remove it when we are done.
12. Third-party services
The Services rely on, and may link to, third-party products and services such as WordPress, your web host, themes and plugins, CREA, Google Maps, payment processors and email providers. These are governed by their own terms and privacy policies. We are not responsible for them, for their availability, or for changes they make.
13. Our intellectual property
Except for the plugin software (its code and the files bundled with it), which is licensed under the GPL, the Services, including the Realtie name, logo, website, designs, documentation, the Realtie Handbook, emails and other content, are owned by Realtie or its licensors and protected by law. You may not copy, modify, distribute or create derivative works from them without our written permission. If you send us ideas or feedback, we may use them freely and without any obligation to you.
14. Changes to the Services
We regularly improve the Services, and we may add, change or remove features. If we make a change that materially reduces the core functionality of your paid plan, we will tell you in advance, and you may cancel. We may also stop offering a plan or the Services altogether. If we do, we will give you at least 30 days’ notice and will refund any amount you prepaid for the period after the Services end.
15. Disclaimers
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties or conditions of any kind, whether express, implied or statutory, including warranties or conditions of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the Services will be uninterrupted, error-free or secure, that they will work with every theme, plugin, host or data feed, that listing data will be accurate or complete, or that you will get any particular search engine ranking, traffic, leads or sales.
16. Limitation of liability
- To the fullest extent permitted by law, Realtie and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, data or opportunity, however caused, even if we were told they were possible.
- To the fullest extent permitted by law, our total liability for all claims relating to the Services or these Terms is limited to the greater of (a) the amount you paid us for the Services in the 12 months before the event giving rise to the claim, or (b) CAD $100.
- Some laws do not allow certain exclusions or limits. Where that is the case, these limits apply only as far as the law allows, and nothing in these Terms limits liability that cannot be limited by law.
17. Indemnity
To the extent permitted by law, you will defend, indemnify and hold harmless Realtie and its owners, employees and contractors from any claims, losses, damages, fines and costs (including reasonable legal fees) arising from: your website or its content; your use of listing data or your DDF® access; your handling of your visitors’ personal information; your breach of these Terms; or your violation of any law or third-party right.
18. Suspension and termination
- We may suspend or end your access to the Services, or deactivate your licence key, if you seriously or repeatedly break these Terms, if you do not pay, if we are required to by law, or if your use puts the Services, our customers or others at risk. Where reasonable, we will tell you first and give you a chance to fix the problem.
- You may stop using the Services at any time by cancelling your subscription.
- Sections that by their nature should continue after the Terms end will continue, including sections 5 (as to refunds owed), 7 (as to the brand), 8, 9, 10, 13, 15, 16, 17, 20 and 21.
19. Changes to these Terms
We may change only these parts of these Terms on our own: prices (section 3), plan features (section 14), support (section 11), acceptable use (section 10) and third-party services (section 12). We will not use this to make cancellation or refund terms worse for you. We will email you at least 30 and no more than 60 days before a change takes effect, with the changed wording and a plain explanation of it, and you may cancel without charge. We may also correct typos or make changes that do not affect your rights at any time. Any other change needs your agreement. The current version of these Terms is always on this page, with the date at the top.
20. Governing law and disputes
- These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there.
- If you have a concern, please contact us first. Most issues can be resolved quickly by email. If we cannot resolve a dispute informally, it will be decided by the courts of British Columbia, and you and we agree to their exclusive jurisdiction.
- If you are a consumer, nothing in these Terms takes away rights you have under the consumer protection laws of your province or territory that cannot be waived by contract.
21. General
- Entire agreement. These Terms, the Privacy Policy and the details of your plan at checkout are the entire agreement between you and us about the Services.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we do not enforce a right right away, we have not given it up.
- Assignment. You may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition or sale of our business or assets.
- Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages at hosting, payment or data providers, internet failures, or natural disasters.
- Electronic communications. You agree that we can send you notices and service messages by email to the address on your account, and that electronic agreements and notices count as being “in writing”.
